Law firm collections letter template: the final notice

When to send a final notice, what it should say, and a letter and email your firm can copy.

By ARCounsel · Last updated

A final notice is the last written step before a firm decides what to do with an unpaid account. It should be calm, specific and short. Below is a law firm collections letter template for a final notice, an email version, and a checklist.

What should a law firm final notice letter say?

State the balance, the invoice dates and the original due date. Give one clear deadline and a payment link. Offer a payment plan on terms the firm has approved, and invite questions about the bill. Then say plainly what happens next if the account stays open, naming only a step the firm has actually decided to take.

When to send a final notice

Send a final notice after the routine reminders and at least one phone call have gone unanswered, usually somewhere between 30 and 60 days past due. After a run of friendly reminders, a final notice reads as fair rather than as a threat. The ABA’s GPSolo division outlines a similar order: a reminder once a payment is a week late, a call at two weeks, and a call plus a mailed notice at a month past due (ABA, 2022). For the earlier messages, see our sample reminder emails and call script for unpaid legal fees.

What to include in a law firm collections letter

A law firm collections letter needs to say who it is from, what is owed, by when, how to pay, how to raise a question, and what happens next.

What to leave out of a final notice

Leave out anything that goes beyond what the firm will actually do, and anything about the substance of the matter.

How to send a final notice

Send the letter by mail and by email on the same day, and log both. A client who ignores email may still open a letter, and the email carries a payment link. Clio’s 2023 Legal Trends Report found that firms collecting 75 percent or more of their payments electronically collect half of their bills within three days of issuing them (Clio, 2023).

What happens after the deadline

After the deadline, do exactly what the letter said, and nothing more. If the client pays or agrees to a plan, confirm the terms in writing. If the client questions the bill, pause and pass it to the billing attorney. Our guide to handling a client who disputes attorney fees covers that step. If there is no response, the billing attorney makes and records a decision: keep a plan open, write off the balance, or refer the account out. Whether a firm may refer an account to an agency depends on state rules. See whether a lawyer can send a client to collections.

Final notice checklist

Run these eight checks before a final notice goes out.

ARCounsel is a done-for-you accounts receivable follow-up service for law firms that connects read-only to QuickBooks Online, LeanLaw and Clio. Its AR specialists follow up for about 90 days on templates the firm approves and flag disputes right away. Any account still open goes back to the firm with a full activity log, so the billing attorney can decide on a final notice.

Frequently asked questions

How long should a final notice give a client to pay?

Ten to 14 days is common. It gives the client time to pay or ask for a plan, and it is short enough that the letter stays on their mind. The ABA GPSolo article cited above suggests a similar window for invoices themselves.

Should the attorney sign a final notice letter?

It can help. The ABA GPSolo article notes that clients may be more inclined to pay when they hear from the lawyer than from the bookkeeper. Whoever signs, the letter should name one contact person for questions.

Can a final notice mention a collection agency?

Only if the firm has decided that referral is the next step, the engagement letter provides for it, and the firm’s state rules allow it. Naming a step the firm won’t take undermines every letter after it.

A note on ethics rules. Rules on fee collection vary by state, including when a firm may charge interest on a late bill or refer an account to a collection agency. Check your state’s rules of professional conduct and ethics opinions, or ask your ethics counsel, before setting a collection policy. This article is general information, not legal advice.
